Primary legislation

  • LBCAA 1990 , Planning (Listed Buildings and Conservation Areas) Act 1990. The principal Act. Sections 16 and 66 impose the special-regard duty for listed-building consent and planning permission affecting setting. Section 72 imposes the preserve-or-enhance duty in conservation areas. Section 1(5) is the source of curtilage listing.
  • Planning (Listed Buildings) (Amendment) Regulations 2023 (SI 2023/1024). The 2023 amendment requiring every LBC application to include a description of significance proportionate to importance.
